Terms of use

These terms govern your use of Couch Cal, the app and website at couchcal.com and app.couchcal.com and the iOS app, operated by Comotoca (comotoca.com), Spain (“we”). By creating an account you accept them. If you do not accept them, do not use Couch Cal.

The service

Couch Cal is a calorie tracker. You log a meal with a photo, a description, a barcode, or a list of what you ate, and an AI provider estimates its calories. Estimates cost coins (see below). We may change, add, or remove features.

Estimates are estimates. They can be wrong, sometimes by a lot. Couch Cal is not medical or dietary advice and does not diagnose, treat, or prevent anything. If you have a medical condition, an eating disorder, or a special diet, talk to a professional before relying on it.

Your account

You need an account, created with an email address and password or with Sign in with Apple or Google. Keep your credentials to yourself; you are responsible for what happens under your account. Give us a working email address: verification and password-reset links go there. You must be at least 14 years old, or older where your country requires it. One person, one account. You may delete your account at any time, in the app or on the web; deletion is immediate and permanent (see the privacy policy).

Coins and subscriptions

An estimate costs coins. Free accounts get 7 coins for life. Subscribers get 7 coins a day, reset at midnight in the timezone of your account. We compute coin costs and your subscription status on our server; your device only shows them.

A subscription is monthly, every six months, or yearly. The price is shown before you buy. On the web, payment is processed by Polar; you cancel in the app’s subscription settings or with Polar, and refunds are handled as Polar’s terms and the law provide. On iOS, the subscription is an auto-renewing App Store subscription: payment is charged to your Apple ID at purchase and at each renewal, 24 hours before the current period ends, unless you turn off auto-renewal in your Apple ID settings at least 24 hours before. You manage, cancel, and request refunds with Apple, not with us; Apple’s terms govern the purchase.

Canceling stops future charges; you keep the subscription until the end of the paid period. We may change prices for future periods with notice through the store or by email. Deleting your account does not cancel a subscription.

If you live in the EU or the UK you can withdraw from a web subscription within 14 days of buying it, for a full refund, by emailing contact@couchcal.com, unless you have started using the daily coins, in which case you agree the right ends.

Your content

Your photos, descriptions, and notes stay yours. You give us the license we need to store, display, and process them, including sending them to the AI providers named in the privacy policy, to run the service for you. Do not upload anything you have no right to or anything unlawful. The apps, the service, and the bear are ours or our licensors’ and are provided for your personal, non-commercial use; you may not copy, scrape, resell, or redistribute them.

Acceptable use

Do not attempt to break into, overload, reverse engineer, or disrupt the service, probe it for vulnerabilities without our written permission, use it to send unsolicited messages, or use automated means to access it other than through the apps and the website. We may suspend or close an account that breaks these terms, after notice where practical.

Availability and warranty

Couch Cal is provided “as is” and “as available”. We do our best to keep it running and your data safe, but we do not promise uninterrupted or error-free service, accurate estimates, or any particular health or weight outcome. To the extent the law allows, we disclaim all implied warranties.

Liability

To the extent the law allows, we are not liable for indirect, incidental, or consequential losses, or for loss of data or profit, arising from your use of Couch Cal, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory consumer rights.

Ending

You may stop using Couch Cal and delete your account at any time. We may end or suspend the service, or your access to it, for a breach of these terms or if we discontinue Couch Cal; in the latter case we give at least 30 days’ notice and a way to export your data (the last 7 or 30 days in the app, or everything by email).

Changes

We may change these terms. We will post the new version here with its effective date and, for a material change, tell you in the app before it applies. Continuing to use Couch Cal after that date means you accept the change.

Law and disputes

These terms are governed by the law of Spain, without prejudice to mandatory consumer protection where you live. Disputes go to the courts of Spain unless the law gives you the right to sue where you live.
